'Bob's Burgers,' 'Arrested Development' actor sentenced to 1 year in prison for role in US Capitol attack | CNN Politics


An actor best known for his roles in “Arrested Development” and “Bob's Burgers” was sentenced Monday to one year and one day in prison for his role in the Jan. 6, 2021, attack on the U.S. Capitol.

Jay James Johnston, 55, was accused of joining a crowd in the Capitol's Lower West Plaza during the riots and filming on his cell phone. He pleaded guilty in July to one felony count of civil disorder.

Prosecutors also alleged that Johnston filmed from atop a stage set up for Joe Biden's inauguration. Johnston also briefly wielded a stolen police riot shield and joined a group effort to push against police guarding an entrance to the Capitol building, according to court documents.

Prosecutors said Johnston “joined a group push against police inside the tunnel, which resulted in a Metropolitan Police Department officer being crushed between the crowd and a door.”

The Justice Department asked the judge to impose an 18-month prison sentence, saying Johnston had not shown remorse or accepted responsibility for his actions.

Johnston initially downplayed the assault in a text message to an associate shortly after Jan. 6, with investigators writing: “The news presented it as an assault. It really wasn't.”

His attorney asked the judge for a lighter sentence, saying that prosecutors “relentlessly overstated” Johnston's role in the attack “because he is an acclaimed Hollywood actor, and the government is using his status to make a point to the public.”

Johnston was also ordered to pay $2,000 in restitution.
