Ice Cream Brand Scoops Customers $8.85 Million In Class Action Lawsuit – See If You're Eligible
Breyers Ice Cream is paying nearly $9 million as part of a class action settlement — and you could be entitled to some of the money.
Supreme Court of the State of New York, Bronx County, September 13 Conopco Inc. and announced a settlement against Unilever United States Inc Conopco and Unilever are the advertisers and parent companies of Breyers, respectively
The class action lawsuit concerned Breyers' Natural Vanilla ice cream flavor, which falsely advertised itself as real vanilla flavor.
“The plaintiffs filed suit against the defendants alleging that the labeling of the defendants' Breyers Natural Vanilla Ice Cream misled consumers that the ice cream contained vanilla flavor derived only from the vanilla plant and not from non-vanilla plant sources, and alleged that it contained no -vanilla plant. Vanilla flavor,” the court explained in a release.

“Defendants dispute all of these allegations and deny any wrongdoing. The court has not decided who is right.”
Customers who purchased Natural Vanilla Flavored-Ice Cream between April 21, 2016 and August 14, 2024, may be eligible for cash back.

Although the jury is still out on the authenticity of the vanilla flavor, the defendants have agreed to fund an $8.85 settlement for customers who paid for the natural vanilla carton.

The court will pay consumers $1 per carton of Breuer's Natural Vanilla ice cream flavor.

To qualify, consumers are asked to submit proof of purchase. Customers with valid receipts are entitled to submit any number of claims they can authenticate.
The court is allowing Breyers customers to submit up to eight claim forms without proof of purchase, which would total payments of up to $8 per person.

The court also established that within one year of the settlement being finalized, Breyers must “develop a new product formula that does not include vanilla derived from a non-vanilla plant source.”
