Jordan Chiles has filed an appeal of the decision that stripped the U.S. gymnast of her Olympic bronze medal, her attorneys announced Monday.

Chiles was stripped of her first individual Olympic medal after the Romanian gymnastics team challenged to the Court of Arbitration for Sport (CAS) a decision to correct her final score in the floor exercise.

CAS eventually upheld the challenge, meaning the US star's bronze went to Ana Barboso of Romania.

Chiles has now decided to appeal CAS' decision to the Federal Supreme Court in Switzerland – where CAS is based.

“From start to finish, the procedures leading to the CAS panel's decision were fundamentally unfair, and it is no surprise that they resulted in an unfair decision,” Chiles' attorneys said in a press release.

His attorneys argue that CAS violated Chiles' “right to be heard” by “refusing to consider his video evidence that showed his investigation was timely submitted” and that Chiles was not properly informed that the president of the CAS panel had a potential conflict of interest.

“Jordan Chiles' appeal presents a simple legal question to the international community—will an Olympic athlete who simply did the right thing stand by when he is stripped of his medal due to fundamental unfairness in an ad-hoc arbitration process? The answer to that question should be no,” said Maurice M. Suh, counsel for Chiles.

“Every part of the Olympics, including the arbitration process, should stand for fair play,” Suh added.

CAS told CNN it could not comment because it had not yet been notified of the appeal by the Swiss Federal Tribunal.

The United States Olympic and Paralympic Committee (USOPC) says it is determined to see Chiles get the recognition she deserves.

“Given CAS's serious errors and oversights in its handling of the case and its ignoring of clear evidence that Jordan rightfully won the bronze, we are determined to ensure that he receives the recognition he deserves. Our commitment to the truth on this matter remains steadfast,” the USOPC told CNN on Monday.

USA Gymnastics (USAG) told CNN it is not directly involved in the appeal at this stage but is supporting Chiles and her team.

“USAG is coordinating closely with Jordan and his legal team and will make supportive filings in court to continue justice for Jordan,” the agency said.

“Chilis believes in competing fairly and honestly and adhering to standards and rules established to ensure fairness to these organizations,” the gymnasts' attorneys added Monday.
